1Acceptance of Terms

By accessing or using MagicWish, you agree to these Terms of Service. If you do not agree, you must stop using the Platform.

2The Platform

MagicWish provides wishlist, gift discovery, sharing, product lookup, store location, and related account features. Some features may depend on third-party services and device permissions.

3Accounts and Eligibility

To access full features, you must register an account.

• You must be at least 13 years of age or the minimum age required in your jurisdiction.
• Registration information must be accurate, current, and complete.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• You must notify us at support@magicwish.com if you become aware of unauthorized account access.

4Profiles, Lists, and Sharing

The Platform allows you to maintain a profile and create wish lists. Some profile details and lists may be visible to other users depending on privacy settings and sharing choices.

• You are responsible for the accuracy and appropriateness of profile, wish list, product, photo, store, and location information you add.
• You can set supported lists to be visible to friends or only to you.
• Friends may view lists you make visible and may use gift-related features such as marking items as given or spotted.
• Deleting a wish, list, or account may permanently remove associated data, subject to legal retention obligations and backup cycles.

5Acceptable Use

• Do not use the Platform for unlawful, fraudulent, or harmful purposes.
• Do not attempt unauthorized access to any part of the Platform or its infrastructure.
• Do not reverse engineer, decompile, or disassemble any part of the application.
• Do not scrape, harvest, or systematically collect data without written consent.
• Do not transmit viruses, malware, or other malicious code.
• Do not impersonate any person or entity or misrepresent your affiliation.
• Do not use the Platform in a way that could damage, disable, or impair its operation.

6Intellectual Property and License

The MagicWish name, logo, design, and proprietary software are owned by us and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use only.

Product metadata, images, and related content may be sourced from third-party providers and retailers. Rights to that content remain with their respective owners.

You retain ownership of User Content you submit. By submitting User Content, you grant us a worldwide, royalty-free license to store and display it as needed to provide the service.

7Third-Party Services

The Platform integrates with third-party services to deliver certain features.

• Product data and metadata providers.
• Authentication and security services.
• Cloud storage and database providers.
• Map, place, geocoding, and directions services.
• Retailer websites for product purchases.

8Termination

We may suspend or permanently terminate access to the Platform at any time, with or without notice, if we reasonably believe you violated these Terms or harmed the Platform or other users.

You may delete your account by contacting support@magicwish.com. Upon deletion, account data and associated wish lists will be removed subject to legal retention obligations.

9Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, virus-free, accurate, up to date, or suited to your specific requirements.

10Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

Our total cumulative liability for claims arising from these Terms or your use of the Platform shall not exceed $100 USD or the amount you paid us in the three months preceding the claim, whichever is greater.

11Indemnification

You agree to defend, indemnify, and hold harmless MagicWish and its officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Platform, User Content, or violation of laws or third-party rights.

12Governing Law

These Terms shall be governed by applicable laws. Disputes shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.

If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

13Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date and notify you within the application where appropriate.
